Meetings

      In general, the meetings are held the second Tuesday of every month at 6:30 p.m. on the 2nd Floor, Village Hall, 9-11 Church Street, Fredonia, New York 14063.

Duties and Responsibilities

    The Zoning Board of Appeals (ZBA) consists of five members.  The Board of Trustees of the Village appoints the members of the ZBA, each for three-year terms.  The Board of Trustees also appoints the chairperson of the ZBA.
    Meetings of the ZBA are held on the second Tuesday of every month and all such other times as the ZBA may determine.  All meetings are open to the public.
    Any alteration to and use of property must be approved by the Building Inspector/Zoning Officer.  If the Building Inspector/Zoning Officer determines that the request is no within the regulations established by the Village, he will deny the requested permit.  The resident may then appeal that decision to the ZBA.
    The ZBA of the Village of Fredonia has all powers as may be conferred upon it by the Village Zoning Ordinance and all the powers set forth in 7-712 of the Village Law of the State of New York.  These duties include, but are not limited to:
    a.  Interpretation-Decides any questions involving interpretation of any provisions of this local law.
    b.  Special Permit-Hears and decides all applications for Special Permits in the Village of Fredonia.
    c.  Sidewalks-Inspects for replacement and authorizes for rebate (actual replacement is home owner's responsibility).
    d.  Variances-May grant variances in accordance with the following:
        I.   Use Variance-May only be granted if unnecessary hardship is established.
        II.  Area Variance-Considered where setback, frontage, lot size, density, or yard requirements of the local zoning law cannot reasonably be met; may grant an area variance on the ground of practical difficulty.
