 <title>Duties and Responsibilities</title>

 <description>&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; The Zoning Board of Appeals (ZBA) consists of five members.&amp;nbsp; The Board of Trustees of the Village appoints the members of the ZBA, each for three-year terms.&amp;nbsp; The Board of Trustees also appoints the chairperson of the ZBA.&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; Meetings of the ZBA are held on the second Tuesday of every month and all such other times as the ZBA may determine.&amp;nbsp; All meetings are open to the public.&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; Any alteration to and use of property must be approved by the Building Inspector/Zoning Officer.&amp;nbsp; If the Building Inspector/Zoning Officer determines that the request is no within the regulations established by the Village, he will deny the requested permit.&amp;nbsp; The resident may then appeal that decision to the ZBA.&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; The ZBA of the Village of Fredonia has all powers as may be conferred upon it by the Village Zoning Ordinance and all the powers set forth in 7-712 of the Village Law of the State of New York.&amp;nbsp; These duties include, but are not limited to:&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; a.&amp;nbsp; Interpretation-Decides any questions involving interpretation of any provisions of this local law.&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; b.&amp;nbsp; Special Permit-Hears and decides all applications for Special Permits in the Village of Fredonia.&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; c.&amp;nbsp; Sidewalks-Inspects for replacement and authorizes for rebate (actual replacement is home owner&#039;s responsibility).&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; d.&amp;nbsp; Variances-May grant variances in accordance with the following:&lt;br /&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp; I.&amp;nbsp;&amp;nbsp; Use Variance-May only be granted if unnecessary hardship is established.&lt;br /&gt; &amp;nbsp;&amp;nbsp; &amp;nbsp;&amp;nbsp; &amp;nbsp; II.&amp;nbsp; Area Variance-Considered where setback, frontage, lot size, density, or yard requirements of the local zoning law cannot reasonably be met; may grant an area variance on the ground of practical difficulty.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp; The Building Inspector/Zoning Officer, as well as the Fire Code Inspector Officer, is located on the second floor of the Village Hall.&amp;nbsp; The telephone number is 716-679-2313.&lt;br /&gt; &amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&lt;/p&gt;</description>
