Multi-Family Units Application

Eligibility

    Since a substantial number of residents of the Village are tenants, a rehabilitation program has been formulated to assist landlords with lower income tenants who are desirous of making necessary repairs to their properties.  The purpose of the rehabilitation program is to enable those property owners to undertake improvements required to maintain their properties in compliance with existing codes.  Those property owners who qualify are eligible to receive assistance on approved work costing from $2,000 to $10,000 per rental unit.

    In order to obtain multi-family rehabilitation assistance, the following conditions must exist:

     1.  The Applicant must be an individual or family who legally holds title to a multi-family structure or rental unit in the Small Cities Target Area as defined in Exhibit A.
          The holding of title must be satisfactory in the opinion of the staff of the Community Development Board.  
    2.  The structure must be in violation of existing codes and ordinances.
    3.  The owner or owners of the structure or structures to be assisted must have all of the assisted units in the structure rented to low income tenants.  In determining whether or not an Applicant's tenants qualify as low income, the tenant's "adjusted gross income" must fall within the income limits described in Appendix A.
    4.  The Applicant (landlord) may not be a member of the public body or officer or employee of the public body who exercises any functions or responsibilities in connection with the administration of the Community Development Program.
    5.  The Applicant (landlord) must have all applicable Village, County and School Taxes paid and current on the property to be rehabilitated and a copy submitted with the application.
    6.  Only one loan for each rental unit per structure will be made available during the term of the Community Development Program.
    7.  The Applicant must agree to rent the assisted units to low-income tenant for at least five (5) consecutive years following rehabilitation, and to certify same to the Village annually.  Owners not in compliance shall be deemed to be in default.
    8.  The Applicant must agree to perform all work stipulated by the Village to bring the structure into compliance with codes and to make improvements as stipulated by the Village to improve the appearance of the structure.
    9.  The Applicant must submit to the Village requested data on the cost of operating and maintaining the rental units to be assisted.  The department will work with the landlord to insure that the required rehabilitation work is financed in a way to allow an acceptable profit margin on the Applicant's investment in the property.
    10. THe units assisted may not be sold for a period of five (5) years without written consent from the Village.
    11. The program will assist only the rehabilitation of existing units.  The program will not fund the conversation of single-family homes to multi-family units, or create additional units in a multi-family dwelling.
    12. Copies of the last two (2) year's tax returns must be submitted.

 

    Applications can be picked up at Village Hall, 1st Floor, 9-11 Church Street, Fredonia, New York 14063, Monday thru Friday 9:00 a.m.-4:30 p.m. in the Village Administrator's Office.
